US Court Mandates Freedom of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The case stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to face human smuggling charges, he was held in immigration detention.

In her order, the judge pointed out that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

Background of the Case

The legal challenge center on disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a ongoing trial in Tennessee.

Conditions of Freedom

The court, who was overseeing his petition to deportation in a Maryland district court, determined that he must now comply with the conditions of his release from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
